Scope

Chakloon Ads, at chakloon.net/add, is the advertising service of the Chakloon package, operated by Haydamax OÜ, registry code 17351554, Narva mnt 5, 10117 Tallinn, Estonia. This document contains the Advertising Policy, which says what may be advertised, and the Advertiser Terms, which form the contract between us and the advertiser.

It supplements the Terms of Service and the Privacy Policy, which apply in full. Payments are governed by Payments, refunds and withdrawal.

Who can advertise

  • You need a Chakloon Passport account and access to the advertiser cabinet at chakloon.net/add.
  • You must be able to conclude a binding contract under the law that applies to you. If you advertise for a company or another person, you confirm that you are authorised to act for them, and the contract is concluded with them.
  • You give true information about yourself and about the advertiser and keep it up to date. Before a campaign goes to review you must enter the name of the advertiser, which is shown in the ad, and the name of the person or company that pays for the ad, and accept this policy by ticking the box in the cabinet.
  • We may refuse to work with an advertiser, for example if earlier ads of that advertiser broke this policy.

Where ads appear

Ads are shown only on Chakloon's own sites. We do not place ads on sites of third-party publishers. Which places on which sites show ads is decided by us; we do not promise a particular site or position.

Chakloon Ads does not target by country or by age. An ad in a language can therefore be seen in any country where that language is read, and by any user of our services, who may be 16 or 17 years old. This is why some categories below are not accepted at all, even where they are lawful in some countries.

Prohibited content

We do not accept ads that promote, contain or lead to:

  • anything illegal in the European Union or in a country where the ad can be seen;
  • illegal goods and services, counterfeit goods, stolen data or documents;
  • weapons, ammunition, explosives and parts or instructions for making them;
  • drugs and other controlled substances, and equipment for their use;
  • tobacco and nicotine products, electronic cigarettes and their liquids, heated tobacco, nicotine pouches and herbal smoking products;
  • alcoholic beverages;
  • prescription medicines;
  • sexual or pornographic content, adult services and dating focused on sex;
  • gambling, betting, lotteries and casino games, also where the operator holds a licence;
  • deceptive or unrealistic claims, such as miracle cures, guaranteed income, get-rich-quick schemes and fake reviews;
  • financial products without the authorisation required by law, pyramid schemes and unregistered investment offers;
  • malware, phishing, pages that collect passwords or card details by deception, or downloads that hide what they do;
  • impersonation of another person, brand, authority or of Chakloon itself, and imitation of system messages, buttons or warnings;
  • hate, discrimination, violence, harassment and content exploiting tragedies;
  • content that infringes copyright, trade marks or other rights of others;
  • political advertising, as described in the next section.

Political advertising

We do not accept political advertising at all. This includes ads by, for or on behalf of a political party, a candidate, a holder of political office or a political campaign, and ads that are meant to influence an election, a referendum, a vote, or a legislative or regulatory process, also when they speak about a social issue rather than a party. If we find such an ad, we stop it.

Restricted content

Some content may be advertised only if it is lawful in every country where the ad can be seen, the advertiser holds any licence, authorisation or registration that the law requires, the ad contains the information that the law requires and we have agreed after review. This includes in particular:

  • Medicines without prescription, medical devices, health products and health services: only products and services that may lawfully be offered to the public, without claims that they cure or prevent disease unless the law allows such a claim.
  • Financial services and credit: only by firms authorised for the service, with the information required by law, such as the annual percentage rate of charge for consumer credit, and without promises of guaranteed returns.
  • Crypto-assets: only by an offeror or a crypto-asset service provider that may lawfully market them in the European Union, with marketing that is clearly identifiable as such, fair, clear and not misleading, consistent with the published crypto-asset white paper and stating where it is published.
  • Dating services: only services for adults that are not focused on sex, without addressing minors.
  • Products for which the law sets age limits, such as energy drinks: only where such advertising is lawful without age targeting, and without addressing minors.

We may ask you for proof of a licence or authorisation. If we refuse a restricted ad, we tell you why.

Creative requirements

A campaign consists of a text ad and, if you wish, banners:

  • Text ad: an image, a headline, a text and the address of your site. It is required in every campaign.
  • Banners: images of 970×250, 300×300, 300×600 or 300×450 pixels. A banner is an image only, and the whole banner is a link.

Every creative must:

  • be clear and legible, in the language of the campaign, and correct in spelling;
  • state truthfully what is offered and by whom, without misleading statements or omissions, false urgency, or a free offer that is not free;
  • not flash, shake or imitate interface elements;
  • not address children or exploit the inexperience of minors;
  • compare with competitors only in a fair and verifiable way;
  • use only images, texts, trade marks and people's likenesses that you have the right to use.

Landing page

The ad must lead to a page that matches it. The page must offer what the ad promises, at the price shown if a price is shown, must show the total price before an order, and must name the advertiser and how to contact them. The page must work, must not redirect to another offer, must not start downloads by itself and must not contain malware or phishing. If the page collects personal data, the advertiser is the controller of that data and must inform people as data protection law requires. If the landing page changes after approval so that it no longer matches the ad, we may stop the ad.

Targeting

Chakloon Ads is targeted by language only. You choose the languages of your campaign, and the ad is shown to visitors whose browser is set to one of these languages. We do not target by personal profiles, interests, browsing history or tracking across sites. We do not build advertising profiles and do not sell data.

The ad widget stores nothing on the visitor's device and sends no identifier of the visitor. To limit how often the same ad is shown, our server uses a hash of the IP address and user-agent of the request, which is kept only as long as needed for these frequency limits.

Moderation and right to refuse

Every ad is reviewed by a person before it is shown. An ad is shown only after approval. We may refuse an ad, ask you to change it, or stop an ad that has already been approved if it breaks this policy, the law or the Community Guidelines, or if we receive a justified notice about it. We tell you the decision and the reason: which rule or law the ad breaks and which facts we relied on. You may reply with corrections or appeal as described in Content moderation and appeals.

Approval is not a legal opinion that the ad is lawful. The advertiser remains responsible for it.

Prices, auction and prepayment

  • Auction. Ads compete in an auction for each display. You set the price you are willing to pay for one thousand impressions (CPM). The minimum price is 0.50 EUR per thousand impressions.
  • Counting. You pay for impressions counted by our system. Invalid impressions and clicks, for example from robots, are not charged. If you think impressions were counted wrongly, write to us; amounts charged by mistake are returned to your balance.
  • Prepayment. Chakloon Ads is prepaid. Impressions are paid from your advertising balance. When the balance or the budget of a campaign is used up, the campaign stops.
  • Changes. You can change the price and the budget of a running campaign; we do not promise a number of impressions or clicks.

Prices are in euro. Haydamax OÜ is not registered for VAT, so no VAT is added and the price you set is the final price.

Invoices and refunds

Top-ups, receipts, invoices, withdrawal and refunds are governed by Payments, refunds and withdrawal. If an ad is refused in moderation, no impressions are charged for it. An unused balance and an unused campaign budget are paid back on request.

Ad marking

Every ad shown by Chakloon Ads carries the label Ad, in the language of the visitor's browser (the label exists in 28 languages), and the name of the advertiser, so that people can see that it is advertising, not content of the site, and who stands behind it. Next to the label, a small i button leads to the page Why am I seeing this ad at chakloon.net/add/ad/, a separate page for each ad. It names the advertiser and the payer, explains that the ad was chosen by the languages of the visitor's browser, says what is not used to choose ads, and tells how to change the languages and how to report the ad. The advertiser must not hide, remove or imitate this label, and must not present an ad as editorial content.

Advertiser's responsibility

The advertiser is responsible for the ad, the landing page and the goods and services offered, and for complying with the law of every country where the ad can be seen, including consumer protection, advertising, language and data protection law.

If you advertise in the course of a business, trade or profession and a third party or an authority makes a claim against us because of your ad or landing page, you compensate us for the resulting damage and reasonable costs, unless the claim was caused by our own fault. We tell you about such a claim without delay and let you take part in the defence. If you are a consumer, you are liable only as the law provides.

Reporting an ad

Anyone can report an ad that breaks the law or this policy. Write to legal@chakloon.com about illegal ads and to abuse@chakloon.com about phishing, malware and fraud, with the address of the landing page. Notices are handled as described in Report illegal content. How to report is also explained on the page Why am I seeing this ad, which the i button on the ad opens.

Suspension and termination

We may suspend ads or the advertiser account if this policy is broken, if a payment is reversed or if an authority orders it. We tell you the reason, as described under moderation above. For a serious or repeated breach we may close the advertiser account. You may stop your campaigns and end the contract at any time in the cabinet; any unused balance is then paid back on request.

Changes to this policy

We may change this policy when the law, the service or our practice change. We tell advertisers by e-mail or in the cabinet at least 15 days before a change takes effect, unless the law requires a change sooner or we must act against a new risk of harm, such as a fraud scheme. If you do not agree, you may stop your campaigns and end the contract before that date and get back the unused balance. Changes do not apply to impressions already shown.
