About these terms

These terms are an agreement between you and Haydamax OÜ, registry code 17351554, Narva mnt 5, 10117 Tallinn, Estonia (we, us). They apply to every website, application and interface of the Chakloon package. By creating an account or using a service you accept them. If you do not accept them, do not use the services. The contract is concluded when you create an account or, for services that need no account, when you start using them. You can save or print this page at any time.

Some services have their own rules in addition to these terms. Where a service rule differs from these terms, the service rule applies to that service, and these terms cover everything it does not. How we handle personal data is set out in the Privacy Policy, and what may be published is set out in the Community Guidelines.

Your Chakloon Passport account

One Chakloon Passport account opens all services. You can sign in with a password or with an external provider (Google, GitHub, Telegram, Discord, Facebook or W3ID).

  • One person, one account. Do not create accounts for other people or in bulk by automated means.
  • Give true information at registration, in particular your date of birth.
  • Keep your password and sign-in methods to yourself. You are responsible for what happens under your account, unless it happens without your fault, for example because of a security failure on our side.
  • Your @handle must follow the Handle Policy. It is valid in all services.
  • Tell us at once at support@chakloon.com if you think someone else uses your account.

Minimum age

You must be at least 16 years old to have a Chakloon Passport account and to use the services. Chakloon Chat is only for people aged 18 or over. We ask for your date of birth at registration, and we close accounts of people below the required age. Details are in Minimum age.

What you may not do

When using the services you may not:

  • break the law, or use a service to help someone else break it
  • publish or send anything forbidden by the Community Guidelines or the Child Safety Standards
  • infringe the rights of others, including copyright, trade marks, personality rights and privacy
  • impersonate another person or organisation, including us
  • send spam or mass unsolicited messages, spread malware or run phishing
  • try to reach accounts, data or systems that are not yours, or test our security without our written permission
  • interfere with a service, including by automated load that a normal person would not create
  • scrape or copy a service, or a substantial part of its content, by automated means, except through our APIs on their terms
  • collect personal data of other users
  • get around limits, quotas, blocks or restrictions we have applied

Your content

What you publish or send stays yours. You give us a non-exclusive, free, worldwide permission to store, copy, adapt for display, show and deliver your content, only as far as needed to run the services and only for as long as the content is in them. Content you made public can be seen by anyone who can open the page. We may keep a copy where the law requires it, for example as evidence in a case reported to the authorities.

You confirm that you have the right to publish what you publish and that it does not break these terms or the law.

Our content and AI-generated material

The software, design, names and marks of Chakloon, and our own texts, belong to us or to our licensors. You may use them only as the services allow. Chakloon Sign is based on DocuSeal, which is licensed under AGPL-3.0, and our changes to it are subject to that licence.

Some material is created by automated systems:

  • Chacki answers are written by a model of Anthropic in the default version and by our own template-based bot in version 0.1, and Chacki images are made by a model of OpenAI.
  • Zori forecasts, search results, news groupings and other calculated material are produced by our systems.

Such material may be incomplete or wrong. It is not legal, medical, financial or any other professional advice. Check what matters before you rely on it, and do not present AI-generated material as made by a person where that would mislead others. Documents from Chakloon Legal are templates and not legal advice. A signature in Chakloon Sign is a simple electronic signature under eIDAS, not a qualified one, and a receipt from Chakloon Papers is not a qualified timestamp.

Content moderation

This section describes, as required by article 14 DSA, which restrictions we may apply and how we decide.

What we may restrict

We may act on content, accounts and use of the services that are illegal or break these terms, the Community Guidelines, the Child Safety Standards or the rules of a service. We may:

  • remove content or disable access to it
  • reduce the visibility of content
  • suspend or close an account
  • suspend payments or the display of ads
  • refuse a handle or a short link

How we decide

Cases reach us through the Report button in the services, through the notice form on the Report illegal content page, through notices sent to legal@chakloon.com, abuse@chakloon.com or child-safety@chakloon.com, through our own checks and through orders of authorities. Automated tools pre-sort cases and help find spam and abuse. Every decision on a restriction is taken by a person at our moderation desk. We apply our rules diligently, objectively and without discrimination, choose the measure in proportion to the harm, and take into account context and the fundamental rights of everyone concerned, including freedom of expression and the freedom and pluralism of the media.

Reasons and appeal

When we restrict your content or account, we tell you what we decided and why, at the latest when the restriction takes effect, except in the cases that article 17 DSA allows, for example where we have no contact details for you. You can appeal within 6 months, free of charge. A different person reviews the appeal, and we answer within 14 days. The full procedure is in Content moderation and appeals.

Some services are paid, for example advertising, paid plans of Chakloon Console and API usage above free quotas. Prices are shown in the service before you pay. Payments are made in euro, by card through Stripe or by bank transfer against an invoice. Kassero keeps one prepaid balance for all Chakloon services. The balance can be used only for Chakloon services, it is not electronic money or a deposit, it bears no interest and it cannot be transferred to other users. Refunds, the right of withdrawal and the rules of the balance are set out in Payments, refunds and withdrawal.

Availability

Most services are free. Free services are provided as they are: we work to keep them running, but we do not promise that they will always be available, free of errors or that no data will ever be lost. Keep your own copy of what matters to you.

For paid services, we are responsible for their conformity with the contract as the law requires. If you are a consumer and a paid service is not in conformity, you have the remedies the law gives you: to have it brought into conformity, a price reduction or ending the contract (Directive (EU) 2019/770).

We may change, limit or discontinue a service or a feature for valid reasons, such as changes in the law, security or the development of the services, and we tell you in advance where we can. If a change to a paid service affects your use of it more than slightly, we tell you in advance on a durable medium, such as e-mail, and you may end the contract free of charge within 30 days of that notice or of the change, whichever is later. If we discontinue a paid service, or you end the contract because of such a change, you get back the unused part of what you paid.

Suspension and termination

You can stop using the services at any time and delete your account. How to do this is described in Your data: access, export, deletion.

We may suspend or close an account that breaks these terms or the law, or that puts other people or the services at risk. As a rule we warn first. We may act without warning in serious cases, for example child sexual abuse material, threats to life or fraud, and where an account repeatedly publishes manifestly illegal content after a warning. You will receive a statement of reasons and can appeal as described above. If an account is closed, an unused Kassero balance is paid back on request.

Liability

If you use the services as a consumer, we are liable under the law for damage we cause by breaching our obligations, limited to the damage that could be foreseen when the contract was concluded. If you use the services for your trade, business or profession, our liability is limited to the amount you paid us for the service concerned in the twelve months before the event, and we are not liable for indirect damage or lost profit.

Nothing in these terms limits liability that cannot be limited by law, including liability for intent, gross negligence and harm to life or health, or the statutory rights of consumers. We are not liable for content of other users or of other websites, except where the law makes us liable, for example when we fail to act on a valid notice.

You are responsible for what you publish and for the way you use the services.

Governing law and disputes

Estonian law applies to these terms. If you are a consumer, you keep the protection given to you by the mandatory law of the country where you live (article 6(2) of the Rome I Regulation).

If you are a consumer living in the European Union, you can bring a claim against us in the courts of the country where you live or in Estonia, and we can bring a claim against you only in the courts of the country where you live (article 18 of the Brussels I bis Regulation). Other disputes go to Harju County Court (Harju Maakohus) in Tallinn, unless mandatory law gives a consumer another court.

Before going to court, please write to us at legal@chakloon.com. Many questions can be solved that way. A consumer can also turn to the Consumer Disputes Committee (Tarbijavaidluste komisjon) at TTJA, https://www.ttja.ee, which settles disputes between consumers and traders out of court.

Changes to these terms

We may change these terms for valid reasons: when the services, the law or the requirements of authorities change, to keep the services secure, or to describe our practice more clearly. We tell you about a material change at least 30 days before it takes effect, in the services or by e-mail. If you do not agree, you can close your account or end the contract for a paid service before that date, free of charge, and get back the unused part of what you paid. Changes required by law or by an authority, or needed to stop an urgent risk to users or the services, may take effect sooner. The version and date at the top of this page always show the current text.

Language

These terms are written in English, and the English text is binding. Translations into Ukrainian, Russian and other languages are provided for convenience. If a translation differs from the English text, the English text prevails, unless the mandatory law of the country where you live as a consumer requires otherwise. If a term can be understood in more than one way, the meaning most favourable to the consumer applies.
