What this page is for
This page describes the notice and action mechanism of the Chakloon services under Article 16 of the Digital Services Act (Regulation (EU) 2022/2065, DSA). Anyone may use it: a user, a person who has no account, an organisation or a rights holder. The services are operated by Haydamax OÜ, registry code 17351554, Narva mnt 5, 10117 Tallinn, Estonia.
Illegal content is information that breaks the law of the European Union or of a member state, for example child sexual abuse material, terrorist content, illegal hate speech, threats, unlawful disclosure of private data, fraud, sale of illegal goods or infringement of copyright and trade marks. Content that is lawful but breaks our rules is handled under the Community Guidelines; you can report it the same way, and we tell you if we assess it under our rules rather than the law.
Where to send a notice
- Report button. In the services where users publish content, such as the social network Chakloon and Chakloon Chat, every post, comment, message, profile and group has a Report button. This is the quickest way, because the notice already carries the exact location of the content.
- The form at the end of this page or legal@chakloon.com for any notice of illegal content in any Chakloon service, including services where there is no Report button yet, search results and snapshots in Chakloon Net, stories in Chakloon News, short links in Chak and copyright notices.
- child-safety@chakloon.com for anything that concerns the sexual abuse or exploitation of children, grooming or any other danger to a child.
- abuse@chakloon.com for spam, phishing and malware, including a phishing or malicious page behind a short link or an advertisement.
- privacy@chakloon.com for requests to remove search results or other material about yourself under data protection law, for example the right to erasure.
What a notice must contain
A notice is complete when it contains:
- Why the content is illegal. A sufficiently substantiated explanation: which law or right you believe is broken and why, and, if you know it, the country whose law applies.
- Exactly where the content is. The full URL, or several URLs, or another precise identifier, such as the handle of the account (@name), the name of the group or channel and the date and time of the message. If one URL is not enough to find the content, add what is needed.
- Your name and e-mail address. We use them to confirm receipt and to tell you our decision. This is not required for notices about child sexual abuse, sexual exploitation of children, trafficking in human beings or an immediate threat to life or safety.
- A statement of good faith. A sentence confirming that you believe in good faith that the information and allegations in the notice are accurate and complete.
A notice that contains these elements gives us actual knowledge of the content where it allows us to see that the content is illegal without a detailed legal examination (article 16(3) DSA). If something is missing, we may ask you for it; we still look at an incomplete notice and act on it if the content is clearly illegal.
Anonymous notices
You may send a notice without your name and e-mail address if it concerns child sexual abuse or sexual exploitation of children, as article 16(2) DSA allows, and we also accept anonymous notices about trafficking in human beings or an immediate threat to the life or safety of a person. Use child-safety@chakloon.com where children are concerned, and legal@chakloon.com or the Report button in the other cases. We cannot confirm receipt of an anonymous notice or tell you the decision, but we handle it in the same way. Other notices without a name and e-mail address are treated as incomplete, as described above.
Copyright and other intellectual property
Notices about copyright, trade marks and other intellectual property follow the same procedure. In addition, please tell us:
- which work or mark is concerned and where the original can be found;
- that you are the rights holder or are authorised to act for the rights holder, and on what basis;
- whether the use is licensed in any way that you know of.
Where it is strictly necessary for the person who published the content to respond, for example in a dispute about who holds the rights, we may tell them your name or the name of the rights holder (article 17(3)(b) DSA). If you do not want your name passed on, say so in the notice.
Where article 17 of Directive (EU) 2019/790 applies to our services, for example to works shared on the social network, in Chakloon Chat channels or in Chak, we follow the rules for new services with a small turnover: we act expeditiously on a sufficiently substantiated notice from a rights holder and remove the work or disable access to it. Rights holders who want to license works for use in our services can write to legal@chakloon.com. Removal never affects uses allowed by law, such as quotation, criticism, review, caricature, parody or pastiche, and the person who published the content can appeal, and the appeal is reviewed by a person.
What happens next
- Confirmation. If you gave an e-mail address, we confirm receipt without undue delay.
- Review. The moderation desk, a person, reviews the notice. Automated tools help to sort notices by urgency but do not take the decision. Child safety and immediate threats are handled immediately; other notices as a rule within 24 hours.
- Decision. We decide in a timely, diligent, non-arbitrary and objective manner. Possible measures are removal or disabling of access to the content, reduced visibility, suspension or closing of an account, suspension of payments or ads, and refusal of a handle or a short link. We may also decide that no action is needed.
- Your answer. We tell you our decision without undue delay, whether automated means were used, and how you can seek redress if you disagree.
- The other side. The person whose content is affected receives a statement of reasons: what was decided, the facts and grounds, whether automation was used, the legal or contractual ground and how to appeal.
Both the notifier and the affected person can appeal within 6 months, as described in Content moderation and appeals. You can always go to court instead or as well.
Where content gives rise to a suspicion of a criminal offence that threatens the life or safety of a person, we inform the police, as described in Requests from authorities. Child sexual abuse material is reported to the competent authorities, as described in the Child Safety Standards. Records of notices are kept for up to 12 months.
Misuse of the procedure
A notice is not a tool for silencing lawful opinions, competitors or critics. Knowingly false or abusive notices may breach the Terms of Service and the law. If a person or organisation frequently sends manifestly unfounded notices, we may, after a warning, stop processing their notices for a period of time.
Accounts that repeatedly publish manifestly illegal content are suspended after a warning.
Emergencies
If someone is in immediate danger, call the police or the emergency number of your country first (112 in the European Union). Then tell us, so that we can remove the content and preserve evidence.
